Michael Kaminski

Utilising his deep financial and IT knowledge, Michael co- founded an airline called 1time Airways which grew from a single DC 9 to a listed airline operating 737 aircraft, employing over 1,500 staff with a 25% market share transporting more than 3 million passengers per year. Michael was responsible for the creation of the entire bespoke digital platform, management system and an eCommerce platform that transacted upwards of US$250 million dollars a year.

    1. This privacy policy sets out and governs the way in which Plutus Commerce (Pty) Ltd and its holding company or subsidiaries (herein individually and collectively referred to as the “Company”) collects, holds, uses, protects, processes and discloses the personal information that the Users (namely yourselves) provide to the Company when utilising this Platform. The Company recognises and values the importance of the User’s personal information and protecting such information and is committed to ensure that the privacy of the User is protected, subject to the terms contained herein. To this end, the Company undertakes that it will use such personal information in accordance with the terms and provisions as set out in this private policy.

    2. The Company may change the terms and provisions as set out in this privacy policy from time to time and the User shall be bound by any amendments to this privacy policy to the extent that it continues to use the services provided by the Company after any amendment has been effected to these terms of the privacy policy, the User shall be deemed to have accepted the amended terms. In this regard, the User is required from time to time to review this privacy policy. In addition, the Company undertakes to take reasonable steps to bring the amendments to this privacy policy to the attention of the User, however the Company shall not be liable in any way whatsoever for any failure on the part of the Company to bring such change to the attention of the User.


    1. The Company will gather and collect any, alternatively all of the following information from the User:
      1. Personal information: including but not limited to full name, job title, contact information (mobile number, telephone number, email), date of birth, gender, social network contacts and publically available details, employer, country of residence, demographic information (preferences and interests). This information shall be provided directly from the User when registering for the use of the Platform or when the User is in contact with the Company. Alternatively, the information may be provided/obtained by the Company from other sources such as social networks and other public platforms including but not limited to promotion or competition reports and platforms;

      2. Device Information: including but not limited to information obtained from the relevant device used by the User to access and use the Platform, including but not limited to, location information, mobile network information, operating systems of device, and browsing types; and
      3. Other Information: including but not limited to information obtained when the User contacts the Company (which correspondence may be recorded), research surveys completed by the User, details of the transactions and activity taken place on the Platform by the User, duration and frequency of use on the Platform, location data, web-log data, server log data, browse type, language, viewed pages and any other information ancillary thereto.

    2. The Company may associate any of the above information with one another and can (at its discretion) use and treat the combined information as personal data in accordance with this privacy policy.

    3. All of the information contemplated herein above shall be referred to herein as “Personal Information” for the purposes of this privacy policy.


    1. 3.1 The Company requires the information in order to understand the needs of the User with the aim of providing better services to the User. To this end, the Company uses the Personal Information for, including but not limited to, the following reasons:

      1. to improve the services and products provided by the Company;

      2. internal record keeping purposes;

      3. to provide the User with useful information relating to products and services;

      4. to communicate with the User;

      5. to report information to third parties (including advertisers) for consumer and marketing analysis purposes and to permit certain third parties to use data and to provide the User with goods and services that they deem to be of interest to the User;

      6. to assist the Company in determining the interests, of the User for the purposes of sending promotional emails, special offers and other information that the Company deems (in its sole discretion) to be of interest to the User;

      7. to contact the User for market related and research purposes;

      8. to customise and amend the Platform according to the common interests determined from the information;

      9. to facilitate the supply of services and products to the User;

      10. general technical, operational and administrative purposes; and

      11. data analysis and marketing research.

    2. The Company will only contact the User by email, phone or other electronic means in relation to the above.

    3. Should the User not want the Company to use the Personal Information in this manner, the User should not utilise this Platform in any manner or form.


    1. Cookie” is a small file which asks permission to be placed on the hard drive of the User’s device.

    2. 4.2 In the event that the User accepts and grants permission for the Cookie to be placed on the hard drive of the device, the Cookie will, amongst other things, analyse, gather and monitor the User web activity, including the pages which are commonly visited by the User, the likes, preferences and dislikes of the User, which information will be utilised in order to improve/customise the Platform to the User’s personal needs.


    The Company shall be entitled to disclose the Personal Information as follows:

    1. to any person, officer, director, employee, agent, licensor, subsidiary and/or supplier of the Company or a holding company of the Company or any entity/person within the Company’s group of companies, which information is disclosed in connection with the supply of services and products (the “Company Entities”);

    2. to any third party, including but not limited to the Company’s customers, sponsors, and advertisers;

    3. as authorised and/or required by law;

    4. to enforce or apply the user license agreement and/or terms and conditions of use;

    5. the Company shall be entitled to share the Personal Information with its international affiliated companies and the Personal Information may be sent out of the borders in which the Personal Information has been obtained, as permitted by law;

    6. in order to prevent certain breaches and protect rights, safety of User’s personal information; and

    7. 5.7 any ancillary matters related to the above.


    1. The Company acknowledges the importance of your Personal Information and is committed to protecting and securing all the Personal Information. In this regard, the Company has taken all reasonable steps to ensure the safety of such information including but not limited to putting in place the necessary firewalls, physical security, electronic, access and managerial procedures and controls.

    2. The Company shall further take all reasonable steps to maintain the accuracy of the Personal Information, keep the Personal Information up-to-date and exclude and destroy all Personal Information which is not necessary for the services provided by the Company.


    The User has the right to access certain Personal Information and/or may request details of such Personal Information in accordance with the provisions of the relevant applicable laws in the relevant jurisdiction in which the transactions take place. The cost of providing the information from the Company to the User shall be borne by the User.


    1. The Personal Information collected, gathered and acquired by the Company shall be stored on a secure server of the Company or any of the Company Entities. By the User utilising the Platform it agrees to the transfer, processing and storing of the Personal Information as contemplated herein. Whilst the Company undertakes to store the Personal Information on secured servers, the Company cannot guarantee and does not guarantee herein the secure and protected transfer and transmission of such information.

    2. The Company shall retain the Personal Information of the Users for so long as it uses the information for the purposes contemplated herein. In instances where the Company does not require the information any longer, it shall take all reasonable steps to delete and destroy such information in a secure manner to ensure protection of the Personal Information. Notwithstanding the above, the Company shall be entitled to retain the Personal Information for a period of at least 2 (two) years from the last date on which the User accessed the Platform for the purposes contemplated herein.

  9. LINKS

    The Platform may from time to time contain links to other websites, in the event that the User follows any of these links to other websites, it is noted that the Company has no control over the other websites and the Company holds no responsibility or liability for the protection and privacy of any information provided whilst the User visits these sites and such sites are in no way or form governed by the provisions of this privacy policy.


    1. The User by the use of this Platform agrees, acknowledges and consents to the use of his/her Personal Information in the manner contemplated in this privacy policy.

    2. The Company undertakes to comply with all applicable laws as lawfully qualified herein in the applicable jurisdiction in respect of the collection, storage, usage and disclosure of the User’s Personal Information.
